Down in Africa (“DIA”) is a division of LATravel Group (“LAT”, “we”, “us”, “our”). All travel services offered under the Down in Africa brand are operated and managed by LATravel Group, a Canadian company based in Winnipeg, Manitoba. For legal purposes, all bookings are made with LATravel Group.

By visiting our site and/or purchasing travel arrangements from us, you engage in our “Service” and agree to be bound by the following Terms & Conditions (“Terms”), including additional terms and policies referenced herein or available by hyperlink.

Please read these Terms carefully before booking. By paying a deposit, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

• You must be at least the age of majority in your province of residence to book with LAT.
• Parents/guardians are fully responsible for any minors traveling with them and must provide any required notarized permissions for international travel.
• LAT reserves the right to refuse service to anyone at any time.

• A non-refundable deposit of 25% of the total trip cost is required to confirm reservations.
• Certain services (such as gorilla trekking permits) may require higher non-refundable deposits at the time of booking. These will be advised prior to confirmation.
• Final payment is due 90 days prior to departure.
• Reservations made within 90 days of departure require immediate full payment.

• Deposits are non-refundable.
• Cancellations made within 90 days of departure: 100% cancellation fee applies.
• Additional supplier penalties may apply during peak periods or for specialty services.
• No-shows are treated as cancellations and subject to 100% fees.
• LAT is not responsible for supplier default. Refunds, if any, will follow supplier policies.

For any changes made to a trip after the initial deposit has been paid, we reserves the right to charge an administrative fee per change.

We highly recommend that you purchase comprehensive accident, medical, baggage and trip cancellation insurance when you make your trip deposit; please contact us for a quote. Please be advised that if you decline to purchase Trip Insurance, we will not be held responsible for any financial disappointment caused by reasons beyond our control.

We shall not be liable for any claims, losses, damages, costs, expenses, delays or loss of enjoyment, of any nature or kind whatsoever, resulting from events beyond our or a supplier’s reasonable control, including but not limited to acts of God, strikes, lockouts or other labour disputes or disruptions, wars, blockades, insurrections, riots, earthquakes, weather conditions, floods or acts or restraints imposed by government authorities.

Airline tickets are either non-refundable or have substantial change/cancellation penalties. Please check that the names that are to appear on your air tickets coincide with the names on your passports.  We will not be held responsible for incorrect names on tickets, and/or any fees associated with correcting them.

All travelers are required to have a valid passport from their country of citizenship with an expiration date of at least 6 months from date of return from your trip.
Advance visas may be required for certain countries and travelers with certain passports;
Any minors traveling must have notarized permission from both parents; if traveling with one parent, then notarized permission from the parent who is not traveling is required.

Any travel arrangements booked by us do not include gratuities, airfares, porterage, meals, drinks, laundry service and any items of a personal nature unless otherwise specified.
Visa fees are not included and are the responsibility of the traveler to apply for and obtain.

Respect of your privacy is of utmost importance to us. Traversing Travel will never sell the names of individual customers or any other information drawn from their personal profiles to third parties. All direct communication between you and us remains confidential. However for the purposes of reserving your trip and processing any transactions related thereto, we do require certain basic personal information. When you reserve or purchase travel services, we may be required to transmit such information (including your name and address) about you and your purchase to booking/payment processing partner(s), the tour operator, the air carrier or any other travel product or service provider involved; this step is essential to the processing of the transaction. While Traversing Travel makes every effort to ensure respect of your privacy, you understand that for the purpose of verifying the above-mentioned information, we may choose to disclose it to a third party assigned the task of verifying and/or corroborating the information provided as part of your file.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

In no case shall Traversing Travel, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Traversing Travel and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of British Columbia, Canada.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
